These terms govern RTOPilot Jobs, the job board at jobs.rtopilot.com.au. They are separate from the terms covering the RTOPilot training management platform.
1.1.1The following definitions apply:
1.2.1headings are for convenience only and do not affect interpretation; the singular includes the plural and the reverse; and a reference to legislation includes any amendment to it.
2.1The Board is a job board for the Australian vocational education and training sector. It allows Employers to advertise roles and Candidates to find and apply for them.
2.2We provide the Board as a venue. We are not a party to any employment relationship, we do not act as an employment agency, and we do not act as agent for either a Candidate or an Employer.
2.3By using the Board you agree to these Terms. If you do not agree, you must not use the Board.
2.4You must be at least sixteen (16) years of age to create an account or submit an application.
2.5You are responsible for the security of your account credentials and for activity carried out under your account.
3.1.1Listings submitted by an Employer through the self-service posting flow are held for review and are published only once approved by us.
3.1.2We may decline to publish, or may remove, any Listing at our discretion, including where it is inaccurate, misleading, discriminatory, unlawful, not a genuine vacancy, or not a role in the vocational education and training sector.
3.1.3We do not verify the accuracy of a Listing, the existence of the role, or the identity, solvency or registration status of an Employer beyond checking a stated RTO registration code against the national register at training.gov.au.
3.1.4An Employer may edit a Listing that is already published. Changes to a published Listing take effect immediately and are not held for approval first. Where a Listing was published through the self-service posting flow, we are told when its title, summary, description, pay or requirements change, and we review those changes after publication. Clause 3.1.2 continues to apply to an edited Listing.
3.2.1A Listing published through the self-service posting flow runs for thirty (30) days, after which it expires automatically and ceases to be shown publicly. A Compiled Listing runs for thirty (30) days from the day we publish it, and for a further thirty (30) days from the day the Employer claims it. Any other Listing we publish ourselves through our management console has no fixed term: it stays on the Board until it is closed, marked filled, or removed.
3.2.2We do not monitor whether a role remains open. An Employer must tell us, or close the Listing, when a role is filled or withdrawn.
3.3.1An Employer must not post a Listing that:
4.1Posting a Listing on the Board is presently provided at no charge. Applying for a role is, and will remain, free for Candidates.
4.2We may introduce fees for Employers in future. We will publish the fees before they take effect, and no charge will be made for a Listing posted before the fee took effect.
4.3Where a payment is taken, it is processed by our payment provider. Card details are entered directly with that provider and are not received or stored by us.
5.1Some Listings on the Board are created by us rather than by the Employer. These are either compiled from a role the Employer advertised publicly on its own website, or entered by us on the Employer’s behalf. In both cases the Employer has not registered with us and has not asked to be listed.
5.2Where a Compiled Listing was taken from a public advertisement, we identify the source and record its address. Where it was entered by us on the Employer’s behalf, no source is shown, because there is no advertisement it was taken from.
5.3A Compiled Listing reproduces the substance of the Employer’s own advertisement, together with the Employer’s business name and, where one is recorded on the national register, its RTO registration code. We identify such Listings as compiled, and where one was taken from a public advertisement we record that advertisement’s address, as set out in clause 5.2.
5.4We claim no ownership of the content of a Compiled Listing. Copyright in an Employer’s advertisement remains with the Employer.
5.5An Employer may at any time, and without giving a reason, require us to remove a Compiled Listing, or to refrain from compiling its roles in future, by contacting us under Section 12. We will action such a request promptly.
5.6A Compiled Listing does not accept applications through the Board while it remains unclaimed. It directs applicants to the Employer’s own advertisement, so that no application is collected for an Employer that has not asked us to collect one.
5.7An Employer may claim a Compiled Listing, take control of its content, and from that point receive applications through the Board directly.
5.8Where we invite an Employer by email to claim a Compiled Listing, that invitation includes a means of declining further contact, and an address that has declined is not contacted again.
6.1A Candidate must:
6.2A Candidate acknowledges that an application, and the Evidence attached to it, is disclosed to the Employer advertising the role, and that the Employer then handles that information under its own obligations.
6.3Submitting falsified Evidence is a serious matter and may be reported to the affected Employer and, where appropriate, to a regulator.
7.1An Employer shall:
7.2An Employer must not use Candidate information obtained through the Board for marketing, for building a database, or for any purpose other than the role applied for.
8.1An Employer retains ownership of the content of its Listings, and grants us a non-exclusive, royalty-free licence to publish, display, reproduce and distribute that content on the Board and in search results for as long as the Listing is published, and to retain a copy afterwards for our records.
8.2A Candidate retains ownership of the content of their application and Evidence, and grants us a licence to store it and to transmit it to the Employer advertising the role.
8.3The Board itself, including its software, design and compiled data, remains our property. You must not copy, scrape, or systematically extract content from the Board without our written consent.
9.1Our handling of personal information is described in the RTOPilot Jobs Privacy Policy, which forms part of these Terms.
9.2Evidence documents are deleted approximately six (6) months after the role they were submitted for closes. Other application details are retained until deleted on request.
10.1We aim to keep the Board available at all times, but we do not warrant uninterrupted or error-free operation, and we may suspend access for maintenance.
10.2Support is provided by email to support@xmb.com.au and through the support window on the Board. We do not offer a guaranteed response time.
11.1.1Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy conferred by the Australian Consumer Law which cannot lawfully be excluded.
11.2.1Subject to clause 11.1.1, and to the maximum extent permitted by law, our total liability arising out of or in connection with these Terms shall not exceed the greater of the fees paid to us in respect of the Board in the twelve (12) months preceding the event giving rise to the liability, or one hundred dollars ($100).
11.2.2Subject to clause 11.1.1, we shall not be liable for:
11.3.1You shall indemnify and hold us harmless against any claims, damages or losses arising from your breach of these Terms, your misuse of the Board, your violation of a third party’s rights, or your non-compliance with applicable laws.
12.1These Terms commence when you first use the Board and continue until terminated.
12.2You may stop using the Board at any time. We may suspend or terminate access immediately where these Terms are breached, or on reasonable notice for any other reason.
12.3Upon termination, the right to access the Board ceases and any published Listings may be removed. Sections 8, 9, 11 and 13 survive termination.
13.1.1These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales.
13.2.1These Terms, together with the Privacy Policy, constitute the entire agreement between the parties in respect of the Board and supersede all prior agreements, understandings and representations.
13.3.1If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13.4.1You shall not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations upon notice.
13.5.1We may update these Terms from time to time. The date at the top of this page shows when they were last updated, and continued use of the Board after that date constitutes acceptance.
